Consumer-tier AI accounts — the free or individually-paid version of tools like Claude, ChatGPT, or Gemini that anyone can sign up for with a personal email — carry meaningfully different risk than enterprise or business-tier accounts, even when the underlying model is the same. Governance policies need to draw this line explicitly, because most staff will not intuit it on their own.
Why the Tier Matters, Not Just the Tool
The same AI model can sit behind very different data-handling terms depending on the account tier. Consumer-tier terms frequently permit the vendor to use submitted data for model training and may retain data for extended periods. Enterprise or business-tier agreements typically include data controls that exclude submitted data from training and offer defined retention terms — but these protections apply only when the workflow is actually run through the correctly configured enterprise account, not a personal one.
Common Misconceptions
- “It’s the same AI, so it’s fine.” The model may be similar, but the contractual data-handling terms attached to a personal account are not the same as an enterprise agreement.
- “I didn’t share anything sensitive, just a shipment log.” Shipment logs, lane data, and carrier performance information can still be commercially sensitive or contractually protected, even without patient-identifying information present.
- “No one will know.” This isn’t a reason to accept the risk — it’s a description of the shadow AI problem covered in AI Governance: Shadow AI Risks.
Practical Guidance
- Never enter organizational data — including shipment, carrier, supplier, or deviation data — into a personal/consumer AI account, regardless of how minor the data seems.
- Confirm which specific account and tier is provisioned for organizational use before assuming any AI tool is approved for a given data category.
- When in doubt about whether a category of data is sensitive enough to require enterprise-tier handling, treat it as sensitive until confirmed otherwise.
